POTENSI KONFLIK DALAM TRADISI PERKAWINAN ETNIS MADURA PERSPEKTIF MASLAHAH MURSALAH (Studi Kasus Uang Asap Pada Keluarga Madura Desa Sutera Kecamatan Sukadana Kabupaten Kayong Utara)

Abstract

The Madurese ethnic marriage tradition in practice also has the potential to cause conflict, both in the high smoke money, the standard of smoke money determined by the community and the unilateral determination of smoke money. This research aims to identify potential forms of conflict in the Madurese marriage tradition and analyze them through the maslahah mursalah approach, which is the consideration of benefits that are not based on specific arguments, but are still relevant in determining Islamic law. The research method used is descriptive qualitative with data collection techniques through interviews with several respondents including: Village officials, community leaders, and people who use this smoke money. The results show that the potential for conflict generally stems from the incompatibility between customary values and religious norms, differences in social status, and unilateral decisions from the woman's side in determining the smoke money. From the perspective of maslahah mursalah, some elements of the tradition need to be reviewed so as not to cause harm and still maintain the value of social benefits. This study contributes to efforts to harmonize local wisdom and the principles of Islamic law in the context of marriage.

Tradisi perkawinan etnis Madura dalam praktiknya, tradisi ini juga berpotensi menimbulkan konflik, baik pada tingginya uang asap, standar uang asap yang ditentukan oleh masyarakat dan penentuan sepihak pada uang asap. Penelitian ini bertujuan untuk mengidentifikasi bentuk-bentuk potensi konflik dalam tradisi perkawinan masyarakat Madura dan menganalisisnya melalui pendekatan maslahah mursalah, yaitu pertimbangan kemaslahatan yang tidak didasarkan pada dalil yang spesifik, namun tetap relevan dalam menetapkan hukum Islam. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan teknik pengumpulan data melalui wawancara kepada beberapa responden diantaranya: Perangkat desa, Tokoh Masyarakat, dan orang yang menggunakan uang asap ini. Hasil penelitian menunjukkan bahwa potensi konflik umumnya bersumber dari ketidaksesuaian antara nilai adat dan norma agama, perbedaan status sosial, serta keputusan sepihak dari pihak perempuan dalam penentuan uang asap. Dari perspektif maslahah mursalah, beberapa elemen tradisi tersebut perlu dikaji ulang agar tidak menimbulkan mudarat dan tetap menjaga nilai kemaslahatan sosial. Kajian ini memberikan kontribusi terhadap upaya harmonisasi antara kearifan lokal dan prinsip-prinsip hukum Islam dalam konteks perkawinan.
