URGENSI HAK PILIH DALAM KONTEKS ORANG DENGAN KETERBELAKANGAN MENTAL

Abstract

The research aims to analyze the perspective on the right to vote for people with mental disabilities in general elections from a constitutional law perspective. This study utilizes three types of legal materials: primary, secondary, and tertiary legal sources. The findings indicate that the position of the right to vote for people with mental disabilities in general elections is guaranteed under the perspective of constitutional law. This is influenced by their political rights, which are protected by Law No. 8 of 2016 concerning Persons with Disabilities. The recommendation of this study is that improving regulations that are still open to multiple interpretations regarding the rights of voters with disabilities not only requires good regulations but also legal certainty regarding their political rights.

Abstrak

Tujuan penelitian menganalisis pandangan hak memilih bagi penyandang disabilitas mental dalam pemilihan umum ditinjau dari perspektif hukum Tata Negara. Penelitian ini menggunakan tiga jenis bahan hukum, yaitu bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa kedudukan hak memilih bagi penyandang disabilitas mental dalam pemilihan umum perspektif hukum Tata Negara sudah terjamin. Hal ini dipengaruhi oleh hak-hak politik mereka yang dijamin oleh Undang-Undang nomor 8 tahun 2016 Tentang Penyandang Disabilitas. Rekomendasi penelitian ini adalah Pembenahan peraturan- peraturan yang masih multitafsir bagi hak pemilih penyandang disabilitas bukan hanya memerlukan peraturan yang baik, tetapi juga memerlukan kepastian hukum terhadap hak-hak politiknya.
