PENYELESAIAN SENGKETA PELANGGARAN RAHASIA DAGANG OLEH MANTAN KARYAWAN DALAM KASUS PT GENERAL FOOD INDUSTRIES (GFIB)

Abstract

This study aims to analyze the resolution of a trade secret violation dispute involving two former employees of PT General Food Industries (GFIB), namely Rachmat and Andreas, who later worked for a competing company, PT Bumi Tangerang Mesindotama. PT GFIB considered that both had disclosed the company’s trade secrets to a competitor. According to Law No. 30 of 2000 concerning Trade Secrets, such actions are classified as legal violations. This research employs a normative juridical approach using a case study method. The findings indicate that the disclosure of confidential information to other parties without permission violates trade secret protection provisions and may result in criminal penalties. The court's decision sentenced both defendants to two months of imprisonment. This case underscores the importance of confidentiality agreements, legal awareness among employees, and legal protection by companies.
