Abstract

The COVID-19 pandemic that hit Indonesia since early 2020 has had a significant impact on the social and economic conditions of society. The government responded to this crisis by allocating enormous social assistance budgets to help affected communities. However, the implementation of the social assistance program was marred by corrupt practices that harmed the state and society, as reflected in the case of Juliari Batubara as Minister of Social Affairs for the 2019-2020 period. This research examines criminal liability in corruption crimes of COVID-19 social assistance with a focus on juridical aspects and implementation of law enforcement. The research method used is normative juridical with a case analysis approach and related legislation. The results show that the construction of criminal liability for corruption in COVID-19 social assistance cases involves multiple actors with various complex modus operandi. Law enforcement in this case faces significant challenges in proving criminal elements and coordination between law enforcement agencies. This research recommends the need to strengthen supervision and corruption prevention systems in social assistance programs and harmonize regulations related to criminal liability for corruption.
