Abstract

This study examines the implications of Constitutional Court Decision No. 55/PUU-XVII/2019 on the stability of Indonesia’s electoral system, focusing on national political dynamics and constitutional interpretation. The background highlights Indonesia’s shift from a closed to an open proportional system post-reform, which sparked debates between political parties’ interests in internal stability and the principle of popular sovereignty favoring transparency. The research questions address: (1) how national political dynamics influenced the constitutional norm change in the decision, and (2) how the Court’s interpretation impacted electoral system stability. The normative legal method analyzes primary (1945 Constitution, Election Law, Court Decision) and secondary (journals, books) legal materials. Findings reveal that the Court upheld the open proportional system based on popular sovereignty principles, despite political pressure for a closed system. The decision’s impacts include increased voter participation but also challenges like political fragmentation and high campaign costs. The conclusion emphasizes the Court’s effort to balance party interests with democratic principles, though administrative adjustments and public awareness are needed to ensure electoral stability.
