PERLINDUNGAN HUKUM BAGI KONSUMEN DALAM KASUS PENIPUAN UMRAH: ANALISIS TERHADAP PUTUSAN 41/PID.B/2024/PN.KDS

Abstract
Umrah fraud cases in Indonesia are still rampant and cause major losses for prospective pilgrims. This study analyzes the civil liability of Umrah travel agencies and legal protection mechanisms for consumers, with a case study of Decision Number 41/Pid.B/2024/PN Kds. Using normative legal methods and regulatory approaches. This study found that although criminal and civil sanctions have been regulated, the implementation of victim rights recovery is still weak, especially in asset tracking and refunds. The lack of guarantees of consumer financial protection, therefore, it is necessary to strengthen regulations, supervision, and the effectiveness of law enforcement in order to optimally guarantee the position of pilgrims' rights.
Kasus penipuan umrah di Indonesia masih marak terjadi dan menimbulkan kerugian besar bagi calon jemaah. Penelitian ini menganalisis tanggung jawab perdata biro perjalanan umrah serta mekanisme perlindungan hukum bagi konsumen, dengan studi kasus Putusan Nomor 41/Pid.B/2024/PN Kds. Menggunakan metode yuridis normatif dan pendekatan peraturan perundang-undangan. Penelitian ini menemukan bahwa meskipun sanksi pidana dan perdata telah diatur, implementasi pemulihan hak korban masih lemah, terutama dalam pelacakan aset dan pengembalian dana. Kurangnya jaminan perlindungan finansial memperburuk posisi konsumen, maka dari itu, diperlukan penguatan regulasi, pengawasan, dan efektivitas penegakan hukum guna menjamin hak-hak jemaah secara optimal.
