DISPARITAS KEPOLISIAN TERHADAP PENGENDARA MOTOR GEDE (MOGE) YANG MELINTAS JALAN BEBAS HAMBATAN ATAU JALAN TOL DI KAJI MENURUT UNDANG-UNDANG LALU LINTAS

Abstract

          Setiap kendaraan bermotor kualitasnya tentu saja harus dapat dipertanggungjawabkan sehingga dipastikan tidak sembarangan. Untuk itu, sebagai hasil produksi, kondisi teknis dari kendaraan bermotor tidak perlu diragukan lagi. Namun, lain halnya setelah kendaraan beroperasi di jalan dalam waktu yang cukup lama. Kondisi teknis dipastikan mengalami perubahan karena semua komponen kendaraan bermotor dipastikan akan aus, sehingga tidak menutup kemungkinan berpengaruh terhadap kelaikannya. Atas dasar itu, dalam setiap pengoperasian kendaraan bermotor di jalan harus senantiasa dijaga kelengkapan dan kelaikannya, baik kendaraan angkutan penumpang umum maupun kendaraan pribadi. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis disparitas kepolisian terhadap pengendara motor gede (moge) yang melintas jalan bebas hambatan atau jalan tol di kaji menurut undang-undang lalu lintas serta hambatannya. Bertitik tolak dari permasalahan, maka metode penelitian yang digunakan adalah metode penelitian yuridis normatif yaitu hukum dikonsepsikan sebagai norma, kaidah, asas atau dogma-dogma. Hasil penelitian diketahui bahwa Polisi menegaskan moge tidak boleh menggunakan jalan tol karena tol diperuntukkan bagi kendaraan roda empat ke atas. Alasan lain moge tidak diperbolehkan masuk jalan tol adalah kelengkapan keselamatan pengendara motor tidak selengkap dan seaman pengendara mobil. Jika terjatuh saat melaju dalam kecepatan tinggi, dapat dipastikan akibatnya akan fatal. Mobil yang kebetulan melintas juga bisa terkena dampaknya.

For that, as a result of production, the technical condition of the motorized vehicle is not in doubt. However, it is different after the vehicle has been operating on the road for a long time. The technical condition is certain to change because all components of the motorized vehicle will certainly wear out, so it is possible that it will affect its roadworthiness. On that basis, in every operation of a motorized vehicle on the road, its completeness and roadworthiness must always be maintained, both public passenger vehicles and private vehicles. The purpose of this study is to determine and analyze the disparity of the police against big motorcycle riders (moge) crossing freeways or toll roads reviewed according to traffic law and its obstacles. Starting from the problem, the research method used is the normative juridical research method, namely law is conceived as norms, rules, principles or dogmas. The results of the study show that the Police emphasized that moge are not allowed to use toll roads because toll roads are intended for four-wheeled vehicles and above. Another reason moge are not allowed to enter toll roads is that the safety equipment for motorcyclists is not as complete and safe as car drivers. If you fall while driving at high speed, the consequences will certainly be fatal. Cars that happen to pass by can also be affected.
