PERLINDUNGAN HUKUM TINDAK PIDANA PENGANIAYAAN TERHADAP ANAK YANG MENGAKIBATKAN LUKA BERAT (LEGAL PROTECTION OF THE CRIME OF ABUSE OF CHILDREN THAT RESULTS IN SERIOUS INJURY)

Abstract

The crime of child abuse is an act of violence committed against a child, whether physically, sexually or emotionally, which can endanger the child's health, survival, dignity or development. Acts of violence against children by parents, guardians or other caregivers can endanger and pose a threat to children. Forms of violence against children can include neglect, physical violence, emotional/psychological abuse, and sexual abuse. The Child Protection Law also regulates how the law will be implemented against parties who commit acts of violence against children.

The provisions in Article 1 paragraph 2 of Law Number 8 of 1981 concerning the Criminal Procedure Code explain investigations which read as follows:

 "Investigation is a series of investigative actions in terms and according to the methods regulated in this law to search for and collect evidence that will shed light on the criminal act that occurred and in order to find the suspect."  Investigation is the first action carried out by legal authorities to make clear a criminal act, including the crime of serious abuse of children, which has been prohibited and is punishable by criminal law against anyone who commits the crime. The investigation process in Indonesia is carried out by the National Police of the Republic of Indonesia, in  This is one of the spearheads of the government's efforts to create as firm a legal supremacy as possible, which aims to create laws that are fair, honest and equitable.  Law enforcement relating to their duties and authority in the process of investigating criminal acts of serious abuse of children is expected to be able to carry out their duties well and be able to uncover criminal acts of serious abuse of children, one of the things that often happens in the community is a large number of crimes involving children as victims.  Incidents like this are called child abuse, which can include physical abuse, emotional abuse, sexual abuse and neglect.

The process of investigating criminal acts of serious abuse of children involves the application of the law, namely Article 354 and Article 80 Paragraph 1 of Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection.  The process of investigating criminal acts of serious abuse begins with a police report/complaint, carrying out an investigation (arrest, confiscation and search, detention) and submitting the case files to the Public Prosecutor.
