PENERAPAN KEADILAN RESTORATIF (RESTORATIVE JUSTICE) DALAM KASUS TINDAK PIDANA RINGAN

Abstract

Restorative justice (RJ) in the Indonesian criminal law system is one of the alternative cases settlement, especially for minor crimes. This approach emphasizes more on restoring relationships between perpetrators, victims, and society, rather than focusing only on punishment. This article focuses on the analysis of the application of the concept of restorative justice by referring to a case study in Cilacap, where a homeless woman stole a mobile phone to obtain funds for her childbirth needs. The research uses a normative juridical method with a qualitative approach. The results of the study revealed that the local police managed to resolve the case peacefully through a mediation process between the perpetrator and the victim. This case reflects that restorative justice can be a humane, efficient, and contextual solution in dealing with minor legal problems. However, the main challenges still faced include low public understanding and limitations in technical regulations. This article suggests strengthening the capacity of law enforcement officials and providing education to the public to support the implementation of restorative justice to the maximum.

Keadilan restoratif dalam sistem hukum pidana Indonesia menjadi salah satu alternatif penyelesaian perkara, khususnya untuk tindak pidana ringan. Pendekatan ini lebih menekankan pada pemulihan hubungan antara pelaku, korban, dan masyarakat, dibandingkan hanya berfokus kepada pemberian hukuman. Artikel ini berfokus pada analisis penerapan konsep keadilan restoratif dengan merujuk pada studi kasus di Cilacap, di mana seorang wanita tunawisma melakukan pencurian ponsel guna memperoleh dana untuk keperluan persalinannya. Penelitian menggunakan metode yuridis normatif dengan pendekatan kualitatif. Hasil penelitian mengungkapkan bahwa kepolisian setempat berhasil menyelesaikan perkara tersebut secara damai melalui proses mediasi antara pelaku dan korban. Kasus ini mencerminkan bahwa keadilan restoratif dapat menjadi solusi yang manusiawi, efisien, dan kontekstual dalam menghadapi permasalahan hukum yang bersifat ringan. Namun demikian, tantangan utama yang masih dihadapi mencakup rendahnya pemahaman masyarakat serta keterbatasan dalam regulasi teknis. Artikel ini menyarankan penguatan kapasitas aparat penegak hukum serta memberikan edukasi kepada masyarakat guna mendukung penerapan keadilan restoratif secara maksimal.
