Abstract

Traffic is a crucial aspect that supports the process of development and national integration, but violations and accidents still frequently occur, causing problems related to safety, order, and discipline in society. This study aims to analyze the criminological aspects of traffic accidents involving privileged individuals, namely students or college students who come from families close to power, which results in an unfair legal process. This study uses a normative juridical method, which is an approach based on legislation and related legal principles, alongside a literature study from books, journals, and relevant articles. The results show that traffic accidents are not solely due to individual mistakes but are also influenced by a lack of community awareness of regulations, the process of obtaining driver's licenses involving abuse of authority, and the application of privilege by the elite. The criminological analysis using White Collar Crime and Strain Theory reveals that the use of privilege occurs due to pressure and social inequality, thereby making the legal process more lenient and perpetuating injustice. The study concludes that the issue of traffic accidents involving privileged individuals requires a firm, fair, and transparent response to maintain safety and compliance in road use, as well as to provide legal certainty for all members of society.
