Abstract

This paper aims to analyze the link between the increasing cases of femicide in Latin America and the rise of gender-based refugees seeking protection in the United States. Femicide, as an extreme and systemic form of gender-based violence, has forced many women to flee their countries to escape violence and seek legal protection. The study employs a descriptive-analytic method with a qualitative approach, utilizing literature review from academic sources and international organizational reports. The findings reveal that patriarchy, legal impunity, and structural discrimination in the country of origin are major push factors for migration. However, gender refugees face significant challenges in the U.S. due to restrictive and repressive asylum policies. An intersectional approach is applied to uncover the complexity of migrant women's identities and to advocate for more inclusive and responsive protection policies that address their layered vulnerabilities.
