Abstract AbstractThe organization of walimatul 'ursy or wedding parties is part of a tradition that is deeply rooted in Indonesian society, including in the Muslim community. However, a phenomenon has emerged where walimatul 'ursy events take place in public spaces, particularly in the middle of public roads, often causing disturbances to public order, traffic congestion, and hindering the socio-economic activities of the surrounding community. This study aims to examine the practice of conducting walimatul 'ursy in the middle of the road from the perspective of positive Indonesian law and Islamic law, using both normative legal and sociological approaches. Under Indonesia's positive law, such actions can be associated with violations of laws and regulations, such as Law Number 22 of 2009 concerning Road Traffic and Transportation and regional regulations governing the use of public space and public order. From the point of view of Islamic law, even though walimatul 'ursy is an recommended sunnah, the basic principle in its implementation must still pay attention to the public interest (maslahah 'ammah) and not cause mafsadah (loss) to others. The principle of la dharar wa la dhirar (not to harm oneself or others) is the main basis in assessing the practice. Based on the findings of the study, it is known that the implementation of walimatul 'ursy in the middle of the road without official permission from the authorities and without considering public rights is a form of positive violation of the law and is contrary to the basic principles of Islamic law. Therefore, legal education and cultural approaches to the community are needed to prioritize alternative places that are more suitable and do not disturb public order, so that the implementation of walimatul 'ursy remains in line with sharia values and state law rules.

AbstrakPenyelenggaraan walimatul ‘ursy atau pesta pernikahan merupakan bagian dari tradisi yang telah mengakar kuat dalam masyarakat Indonesia, termasuk dalam komunitas Muslim. Namun, dewasa ini berkembang fenomena pengadaan walimatul ‘ursy di ruang-ruang publik, khususnya di tengah jalan umum, yang kerap kali menyebabkan gangguan terhadap ketertiban umum, kemacetan lalu lintas, hingga menghambat aktivitas sosial-ekonomi masyarakat sekitar. Penelitian ini bertujuan untuk mengkaji praktik pengadaan walimatul ‘ursy di tengah jalan dari perspektif hukum positif Indonesia dan hukum Islam, dengan pendekatan yuridis normatif serta pendekatan sosiologis. Dalam hukum positif Indonesia, tindakan tersebut dapat dikaitkan dengan pelanggaran terhadap peraturan perundang- undangan, seperti Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan serta Peraturan Daerah yang mengatur tentang penggunaan ruang publik dan ketertiban umum. Dari sisi hukum Islam, meskipun walimatul ‘ursy merupakan sunah yang dianjurkan, prinsip dasar dalam pelaksanaannya harus tetap memperhatikan kemaslahatan umum (maslahah ‘ammah) dan tidak menimbulkan mafsadah (kerugian) terhadap orang lain. Prinsip la dharar wa la dhirar (tidak boleh membahayakan diri sendiri maupun orang lain) menjadi landasan utama dalam menilai praktik tersebut. Berdasarkan temuan penelitian, diketahui bahwa pelaksanaan walimatul ‘ursy di tengah jalan tanpa izin resmi dari pihak berwenang serta tanpa mempertimbangkan hak publik merupakan bentuk pelanggaran hukum positif dan bertentangan dengan prinsip-prinsip dasar dalam hukum Islam. Oleh karena itu, diperlukan edukasi hukum dan pendekatan kultural kepada masyarakat untuk mengedepankan alternatif tempat yang lebih sesuai dan tidak mengganggu ketertiban umum, agar pelaksanaan walimatul ‘ursy tetap sejalan dengan nilai-nilai syariah dan kaidah hukum negara.
